In accordance with Section 14 of the Constitution of the Republic of South Africa and the rights to privacy outlined therein, including protection against the unlawful collection, retention, dissemination, and use of personal information, and recognising legislation such as the Protection of Personal Information Act 4 of 2013 ("POPI") amendments, regulations, the UK's Consumer Contracts Regulations (CCR), and any other applicable legislation, users hereby agree to Feasts & Treats Privacy Policy applicable to all users of the Feasts & Treats website and mobile food application software, used to access and purchase Feasts & Treats products and services.

By subscribing to the Feasts & Treats mobile application as a service provider or consumer, you explicitly acknowledge that you have read and understood the terms of the Feasts & Treats Privacy Policy. You agree to be notified regarding a "privacy policy update" via instant messaging notification, electronic mail, and/or within the Feasts & Treats application. You also agree to familiarise yourself with any updates as required from time to time. We outline how, why, and when Feasts & Treats uses your Personal Information to comply with POPI, GDPR, and the UK's Consumer Contracts Regulations.

WHY DO WE NEED YOUR PERSONAL INFORMATION

The POPI Act, GDPR, and the UK's Consumer Contracts Regulations collectively mandate that personal information must be collected directly from you through any of our multiple communication channels. This includes, but is not limited to, fulfilling our contractual obligations, providing information, products, or services you request, communicating with you, resolving complaints, ensuring quality control, and adhering to consumer rights.

Your information is essential for notifying you about changes to our platforms, services, products, terms and conditions, privacy policy, or notices, and any other changes that impact our platforms, services, and products.

We respect your privacy and take the protection of Personal Information very seriously. To provide valuable service and protection to both industry and consumers, we need to use some of your Personal Information as identified below and any amendments.

You warrant that the information you provide is accurate, current, true, and correct and does not impersonate or misrepresent any person or entity or falsely state or otherwise misrepresent your affiliation with anyone or anything.

Persons under the age of 18 using the application are deemed to have consent from a parent or guardian to the extent that Feasts & Treats may verify this consent.

    10. Orders submitted (All order details and product details related to order)

  2. If you are a home-based service provider(virtual business) on the Feasts & Treats mobile application platform the following information will be collected:

    1. First Name
    2. Surname
    3. Date of birth / ID number
    4. Email
    5. Password (for logging in account)
    6. Company Name
    7. Food Certifificate
    8. Address
    9. Suburb
    10. Country
    11. Province
    12. Service areas (all suburbs the service provider offers their services to)
    13. Contact number
    14. Emergency contact number
    15. Contact Name
    16. Website
    17. Instagram Handle
    18. Facebook Link
    19. WhatsApp / Mobile Number
    20. Service Offerings
    21. Products (product code, product title, description, price, images)

    Should your Personal Information change or you wish to amend and/or correct this Personal Information, you can do this by updating your registered user information in your account profile. We retain your information for as long as you engage on the application as a service provider/consumer and/or until the purpose for collection thereof has expired or as long as there is a legal requirement to do so, subject to your requesting that we stop processing your personal information.

    COOKIES AND FURTHER INFORMATION WHICH WE MAY COLLECT

  3. USE OF COOKIES:–

    1. A cookie is a small electronic file that is created on your computer’s hard drive when you browse the internet. Once the file is added, the cookie in question helps analyse the web traffic or tracks when you visit a particular site.
    2. Cookies allow web applications and companies to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes, and common browsing interests by gathering and remembering information about your preferences based on your internet usage behaviour.
    3. Overall, cookies help Feasts & Treats provide you with a better website and browsing experience by enabling us to look at which pages you find useful and which you do not. Like which product of ours is more popular compared to others and to send opt-in marketing or communication if you are not a registered user. A cookie does not give us access to your computer or information about you, other than the data you input into our website to identify yourself as a customer and avail yourself for contact regarding a purchase you can make.
    4. Most web browsers automatically accept cookies, but upon landing on www.feastsntreats.co.za each user has to accept the use of cookies when utilising the website.

  4. We may receive further information through your access to the Feasts & Treats mobile application/website:

    1. Log information, through online identifiers, including information on how, when, and for how long you use our Platforms and other services, the content you view, and search queries you submit.
    2. Information about the technological device you use to access or use our Platforms, including the type of device you are using, how you access our platforms, your browser or operating system, and your Internet Protocol address.
    3. The geographic location from which you accessed our platforms, including your device’s global positioning system signal and information about nearby wifi networks and cell towers. We get this information when you use location-enabled services.
    4. Other information about you from third parties, such as social media.

    ACCESS TO YOUR INFORMATION

  5. Your information will be made available to service providers, enabling them to liaise directly with you in the ordering or delivery of goods. It may also be disclosed to law enforcement, government officials, fraud detection agencies, or other third parties when the disclosure of Personal Information is necessary or appropriate in connection with an investigation of fraud, intellectual property infringements, or other illegal activities that may expose us to legal liability or financial loss. Additionally, our service providers (under contract with us) may have access to your information to assist with parts of our business operations, including fraud prevention, marketing, public relations, and technology services, among others.

    PROTECTION OF YOUR INFORMATION

We take comprehensive measures to secure personal information, including physical, technical, and network security, access controls, monitoring of access, secure storage, destruction, and encryption of records of Personal Information. Additionally, we have procedures for Personal Information breach reporting and remediation. Users and service providers are advised to read the Privacy policies of third parties, as Feasts & Treats cannot control how a third party uses personal information.

In line with POPI, GDPR, the UK's Consumer Contracts Regulations, and other applicable laws, you have the right to request your personal information or request its deletion (information may be retained for reasons stipulated herein above). Any complaints or queries may be referred to the Information Regulator of South Africa.
